Trinamool Congress (TMC) national general secretary Abhishek Banerjee, on Tuesday strongly condemned the tabling of 130th Constitution Amendment bill calling it anti constitutional. He called it the validation of the apprehension of opposition while claiming ahead of Lok Sabha election 2024 that if Bhartiya Janta Party (BJP) came to power with absolute majority then they will change the constitution - destroy it. “This constitutional amendment bill can never be passes since it requires two third majority in both Lok Sabha and Rajya Sabha. BJP can never manage to do that. The home minister couldn’t sit on his own place while tabling the bill. This is a gimmick to divert attention from SIR and the issue of electoral fraud. But it confirms our claim that if BJP had gotten majority then they would have changed constitution and destroyed the federal structure” Abhishek Banerjee said.
The three time Diamond Harbour MP challenged to bring new provisions in the bill that will mandate the law to reprimand the investigating officer of the agency and it’s directors if the law enforcement agency fails to prove the allegations or get conviction in 30 days time. The bill, which proposes amendments to Article 75 of the Indian Constitution, seeks to remove central or state ministers, including the Prime Minister or Chief Ministers, who face allegations of corruption or serious offenses and have been detained for at least 30 days. The bill which has now been sent to the Joint Parliamentary Committee, tabled in Lok Sabha by Amit Shah amidst massive uproar with opposition members even tearing the copies of the bill and hurling them towards Shah.
“BJP would initiate cases against NCP Ajit Pawar and after he joined he became pious, so has Assam CM Hemanta Biswa Sharma and Bengal BJP lop Suvendu Adhikari. In the past five years Enforcement Directorate (ED) had been probing 5,892 cases and out of them conviction has happened in only 8 cases which means the conviction rate is less than 1 percent” he added stressing that leaders like former Delhi Minister Satyendra Jain have been not been convicted by CBi even after keeping him behind bars for four years.
Banerjee called it a ploy to keep BJP’s allies under check indicating the bill threatens leaders to toe BjP line or face consequences like loosing ministry and in worst cases topping of government. “I urge the prime minister to create a new SGT - state government toppling ministry and give it to o it very own incompetent and inept home minister Amit Shah. He should give up Home Ministry and the department of Cooperation” he claimed, mocking the bill as an effort to topple governments “like what happened in Maharashtra”
The 130th Constitutional Amendment Bill is one of three bills introduced by the government, alongside the Government of Union Territories (Amendment) Bill, 2025, and the Jammu and Kashmir Reorganisation (Amendment) Bill, 2025. These bills aim to address gaps in current laws, which lack clear provisions for removing high-ranking officials detained on serious charges. However, opposition like TMC argue that the legislation risks centralizing power and eroding democratic safeguards without mandating accountability for those who are bringing the bill or the agencies probing the cases.
